Hanefî mezhebı̇nde kolaylık prensı̇bı̇: El-Hı̇dâye örneğı̇

Abstract

Yüce Allah (c.c.), Kur’an’ı Kerim’de “Allah, kimseyi gücünün yetmeyeceği şeyle sorumlu tutmaz.” (Bakara, 2/286) buyurarak insanı gücünün yettiği kadarıyla sorumlu tuttuğunu ve ona altından kalkamayacağı hiçbir şeyi yüklemediğini beyan etmiştir. Son din olarak gönderilen İslâm, insanların ibadet, mu‘amelât, ahlak gibi hemen her konuda Allah (c.c.) -insan ve insan-insan arası ilişkilerini düzenleyen büyük bir kanunla gelmiştir. İslâm’ın hükümleri, baştan sona insanlar için kolaylıklarla doludur. İslâm’ın hiçbir hükmü insanlar için zor ve yapılamaz değildir. İslâm’ın hükümlerinin insanlara ilk ilan edildiği dönemde bile insanların takati ölçüsünde hükümler getirilerek mükellefler için emir ve yasaklama bildiren âyetler aşama aşama devreye sokulmuştur. İnsanlar bu şekilde İslâm’ın kanunlarına hazır hale getirilmiştir. Allah (c.c.) “Biz, seni bütün insanlık için sadece bir rahmet olarak gönderdik.” (Enbiya, 21/107) buyurarak âlemlere rahmet olması için gönderdiği Hz. Peygamber (s.a.v.) de ümmeti için asla meşakkat verici hükümler koymamıştır. Hz Peygamber (s.a.v.) insanlar için zor denebilecek bazı durumlar oluştuğunda ise, bu meseleleri mümkün olduğu ölçülerde kolaylaştırmalar yaparak çözüme kavuşturmuştur. Hz. Peygamberden (s.a.v.) sonraki dönemlerde gelen müctehid imamlar da, Müslümanların sorunlarına kolaylık ilkesi temelinde çözüm yolları aramışlardır. Çalışmamızda, İslâm hukukunda yeralan Kur’an, sünnet, icma ve kıyastaki hükümlerin Hanefî mezhebinin fetvalarında ve el- Hidâye adlı eserde nasıl geçtiğini kolaylık prensibi çerçevesinde açıklamaya çalıştık. Bu çalışmamızla İslâm’ın insanlar için çok kolay ve yaşanılabilir bir din olduğuna bir kez daha vurgu yaptık.

Islam, sent as the last religion, has come with a great law that regulates the relations of people with Allah (c.c.) -man and human-human relations in almost everything, such as worship, Decrees and morality. The decrees of Islam are full of conveniences for people from beginning to end. No provision of Islam is difficult and impossible for people. Even at the time when the decrees of Islam were first announced to people, decrees were introduced to the extent of people's consent, and verses stating orders and prohibitions were put into operation gradually for taxpayers. People have been made ready for the laws of Islam in this way. Allah (c.c.) “We have sent you only as a mercy for all mankind” (Anbiya, 21/107) The Prophet whom he sent to be a mercy to the worlds by saying. The Prophet (s.a.v. he has never made painful judgments for his ummah. The Prophet (s.a.v.) when some situations that can be called difficult for people occur, he resolved these issues by making them easier to the extent possible. Hz. From the Prophet (s.a.v.) the mujtahid imams who came in later periods also sought solutions to the problems of Muslims on the basis of the principle of convenience. In our study, we tried to explain how the provisions of the Qur'an, sunnah, consensus and comparison contained in Islamic law are passed in the fatwas of the Hanafi sect and in the work called al-Hidaya within the framework of the principle of convenience. With this study, we have once again emphasized that Islam is a very easy and livable religion for people.
