Robert Nozick özelinde liberteryanizmin vergi adaleti tartışması

Abstract

Klasik liberal düşünceye göre devlet sosyal ve ekonomik hayata müdahale etmemelidir. Devlet, güvenlik gibi sadece asli görevlerini yerine getirebilecek kadar harcamada bulunup vergi tahsil etmelidir. Liberteryanizm, klasik liberal düşüncenin devamı olarak minimal devlet anlayışını savunur. Bununla birlikte liberteryanizm, liberal yaklaşımın radikal bir savunusunu yapar. Bu bakımdan liberteryenlere göre devletin fonksiyonelliği ne derece sınırlandırılırsa bireysel özgürlük alanı o derece genişletilir. Bu doğrultuda çalışmanın amacı liberteryen akımın öncülerinden olan Robert Nozick’in düşünceleri çerçevesinde vergi adaleti konusunu araştırmaktır. Elde edilen bulgulara göre liberteryen doktrinde vergi adaletine ulaşabilmenin temel şartı gelir ve servet üzerinden düz oranlı vergi alınmasıdır. Öte yandan Türk vergi hukuku açısından değerlendirildiğinde bu yöntemin gelir ve servet dağılımında adaletsizliği tetikleyici bir etkiye sahip olduğu görülür.

According to classical liberal thought, the state must not interfere with social and economic life. The state must spend only enough to fulfill its essential duties such as security and collect taxes. Libertarianism advocates the minimal state understanding as a continuation of classical liberal thought. Libertarianism, however, makes a radical defense of the liberal approach. In this respect, according to libertarians, the more the functionality of the state is restricted, the more the area of individual freedom is expanded. In this direction, this study aims to search the issue of tax justice within the framework of the thoughts of Robert Nozick, one of the pioneers of the libertarian movement. According to the findings, the basic condition of achieving tax justice in libertarian doctrine is to receive flat tax on income and wealth. On the other hand, when evaluated in terms of Turkish tax law, it is seen that this method has a triggering effect on the distribution of income and wealth.
