Ali El-Kârî ve Şeyhzâde Mehmed Emîn El-Üskübî’nin vekâletle hacca dair iki risâlesi (tahkik-tercüme latinize ve değerlendirme)

Abstract

Vekâlet, toplumsal bir varlık olan insanın hayatının her alanında gündem olan bir konudur. İslâm dini, sadece kulun Allah ile ilişkisinde değil, her halinde denge sahibi olması için yol gösterici kurallar koymuştur. Bu minvalde İslâm hukuku; ister ibâdât, ister muâmelât isterse de ukûbât alanında olsun hayatı kolaylaştırıcı çok sayıda hüküm içermektedir. Bu çalışmada hac ibâdeti, hacda vekâlet, vekilin hacda yapması gerekenler gibi başlıklarla ibâdet yönü ve kimlerin hac için vekâlet vermeye elverişli olduğu, vekilin ve müvekkilin taşıması gereken şartlar konularıyla da muâmelât yönü ele alınmaya çalışılmıştır. Bu kapsamda 17. yy’da yazılmış iki risâlenin tahkîk, tercüme ve latinizesiyle meselenin bu risâlelerde işlenişi değerlendirilmiştir.

Power of attorney is an issue that is on the agenda in every aspect of human life as a social being. The Islâmic religion has set a number of guiding rules to ensure that the servant has a balance not only in his relationship with Allah, but also in every situation. In this context, Islamic law has produced solutions to facilitate social life under the titles of worship, muâmelât and ukûbât. In this study, the aspect of worship has been tried to be discussed with titles such as the worship of pilgrimage, power of attorney for the pilgrimage, what the representative must do during the pilgrimage, and the aspect of transactions with topics such as who is suitable to give power of attorney for the pilgrimage and the conditions that the attorney and the principal must meet. In this context, the treatment of the issue in these treatises was evaluated by researching, translating and latinizing two treatises written in the 17th century.
