Türkiye’de adalet sisteminin değerlendirilmesi: gri ve temel bileşenler analizi

Abstract

Adalet kavramı niteliği itibariyle geçmişten günümüze önemini koruyan bir kavramdır. İnsanların bir araya gelerek yaşamaları sonucunda ise adalet kavramı daha fazla önem kazanmıştır. Zira toplumsal yasamanın bir sonucu olarak toplumda düzen sağlanması gerekmektedir. Bu bağlamda toplumsal yaşamanın da bir sonucu olarak toplumsal ihtiyaçlar ortaya çıkmaktadır. Söz konusu bu ihtiyaçlardan biri ise adalet hizmetleridir. Toplumsal ihtiyaçlardan olan adalet hizmetlerini yerine getirmek ise devletin asli görevlerindendir. Devlet adalet hizmetlerini yerine getirirken harcama yapmak zorundadır. Devletin yapmış olduğu bu harcamalara ise kamu harcamaları adı verilmektedir. Bu çalışmada Türkiye’nin 2003-2023 yılları arasında yıllık veriler ile 10 adet değişkenden yararlanarak gri analizi ve temel bileşenler analizi ile adalet performansındaki değişim ortaya konulmaya çalışılmıştır. Değişkenlere bakıldığında ilk beş değişken adli yargı sistemine ait değişkenleri altıncı, yedinci ve sekizinci değişken ise idari yargıya ait değişkenlerdir. Dokuzuncu değişken tüm adalet sistemine ait personel verimliliğini yansıtırken onuncu değişken ise adalet bütçesinin genel bütçe içerisindeki payını göstermektedir. Türkiye için 2003-2023 yılları arasında yapılan gri ve temel bileşenler analizi sonucunda adli yargıda 2003 yılında en yüksek etkinlik elde edilmiştir. Adli yargıda en düşük etkinliği ise 2020 yılında elde etmiştir. Türkiye için yapılan analizde idari yargıda en etkin 2012 yılında, en düşük yargı etkinliğini ise 2020 yılında elde edilmiştir. Yine yapılan analiz sonucunda önemli düşüşler 2005,2016 ve 2020 yıllarında elde edilmiştir.

The concept of justice is a concept that maintains its importance for humanity from past to present. As a result of people coming together and living, the concept of justice has gained more importance. Because, as a result of social legislation, order must be established in society. In this context, social needs arise as a result of social living. One of these needs is justice services. Fulfilling justice services, which are among the social needs, is one of the primary duties of the state. The state has to spend while providing justice services. These expenditures made by the state are called public expenditures. In this study, the change in Turkey's justice performance between 2003 and 2023 was tried to be revealed by using annual data and 10 variables, gray analysis and basic components. When we look at the variables, the first five variables belong to the judicial justice system, the sixth, seventh and eighth variables belong to the administrative judiciary. While the ninth variable reflects the personnel efficiency of the entire justice system, the tenth variable shows the share of the justice budget in the general budget. As a result of the gray and principal component analysis conducted for Turkey between 2003 and 2023, the highest efficiency in the criminal justice system was achieved in 2003. The lowest efficiency in the judicial judiciary was achieved in 2020. In the analysis made for Turkey, the most effective administrative judiciary was achieved in 2012, and the lowest judicial effectiveness was achieved in 2020. Again, as a result of the analysis, significant decreases were achieved in 2005, 2016 and 2020.
