Muhakemelerde delillerin önemi

Abstract

Muhakemeden gaye gerçeğin ortaya çıkarılmasını sağlamaktır. Delil ise uyuşmazlık konusu olayın olup olmadığı hususunda hâkimde kanaat oluşturmaya yarayan ispat aracıdır. Bu ispat araçları ancak hâkim tarafından değerlendirilir. Bir maddeyi delil olarak değerlendirmek hâkimin kanaatine bağlı olmakla birlikte hâkim, delil olarak değerlendirmede sınırsız bir yetkiye sahip değildir. Çünkü bir şeyin delil olarak kabul edilebilmesi için bazı özelliklere sahip olması gerekir. Yargıtay, delillerin sahip olması gereken özelliklerin çerçevesini çizmiştir. Muhakemelerde öne sürülen deliller, olayla ilgili hususu ispat etmeli ya da çürütmelidir. Öne sürülen delillerin, muhakeme konusu olayla ilgili bir hususu ispat etmesi ya da çürütmesi gerekmektedir. Olayla ilgisi olmayan bir delilin, muhakemede yer bulması mümkün değildir. Olayın bir kısmını veya tamamını yansıtan ve birbirini tamamlayan hususlar delil olarak kabul edilmektedir. Delillerin gerçeğin ortaya çıkarılmasına fayda sağlaması ve ispat edici nitelikte olmaları kanuni bir mecburiyettir. Bu sebeple deliller dikkatle toplanmalı ve değerlendirilmelidir. Yöntemi literatür taraması olan bu çalışmanın amacı delillerin önemini tartışmak, “gerçekler teferruatta gizlidir” prensibiyle daha dikkatli delil toplamak ve adalete yardımcı olmaya çalışmaktır

Social life is complex and contains disagreements, disorders, conflicts, disputes etc. among people as well as regularities. Sometimes, those exceed the limits of what is allowed by the law and go further causing disputes and disorders solvable or crime punishable only in the justice system, which is the authorized party with the power and capability to solve it. The police force, as a preventive public institution, is obliged to help the justice system in the form of making the first investigation and obtaining the available evidences, for instance, in crime scene investigation as well in addition to maintaining public order. Police is the first authority that has the power and capability to collect the evidences in crime scene, which requires high level of sensitivity and susceptibility. Police help the justice system by collecting the ‘material fact’, which is considered as ‘evidence’. ‘Evidence’ is a proof that help the judge develop opinion about whether the case under conflict happened. Those evidences can only be evaluated by the judge. However, the judge does not have unlimited borders in evaluating and accepting what is an ‘evidence’ and what is not. In order to accept something as an ‘evidence’, it has to carry out some specific features, based on the facts collected by the police investigation. The study reviews the literature and makes theoretical discussions on what ‘evidence’ is and how important it is to collect. It discusses the extents to which the judge can accept a fact as an ‘evidence’. The article makes the discussions from the view of police’s role in collecting evidences and the evidence collection process
