Abstract

Devlet iktidarının sınırlandırılması ya da anayasacılık du?şu?ncesi milattan önceki dönemlere kadar gitmekle birlikte, anılan du?şu?ncenin belirgin hale gelmesi yakın dönemlere rastlamaktadır. İnsanoğlu, modern devletin ortaya çıkmaya başladığı dönemlerden bu yana temel hak ve özgu?rlu?klerin gu?vencelenmesi bakımından devlet iktidarının sınırlandırılması gerektiğini du?şu?nmu?ş ve bunun gerçekleştirilmesi için gerekli çareler u?retmeye çalışmıştır. Anayasacılık du?şu?ncesinin gelişimiyle eş zamanlı olarak ortaya çıkan anılan çabaların u?ru?nu? olarak bazı çareler ya da çözu?m önerileri bulunmuştur. Anayasacılığın araçları olarak nitelendirilen bu çareler, hukuk devlet ilkesi, erkler ayrılığı ilkesi, federal yapılanma biçimi, insan hakları du?şu?ncesi, anayasanın u?stu?nlu?ğu? ilkesi olarak sıralanabilir.

Although the idea of limiting the state power or constitutionalism goes back to the pre-Christian era, the aforementioned idea has become apparent in recent times. Since the beginning of the modern state, mankind has thought that the state power should be limited in terms of guaranteeing fundamental rights and freedoms, and tried to produce the necessary remedies for this to happen. As a product of the aforementioned effort, which emerged simultaneously with the development of constitutionalism, some remedies or solution proposals were found. These remedies, which are described as the tools of constitutionalism, can be listed as the principle of the rule of law, the principle of separation of powers, the federal structure, the idea of human rights, and the principle of supremacy of the constitution.
