1982 anayasasına göre insan hakları kavramı

Abstract

İnsan hakları kavramı insanın sırf insan olması dolayısıyla, doğuştan ya da ana rahmine düşmesinden itibaren sahip olduğu ve devlet ve bireyler tarafından dokunulamayan haklar bütününü ifade eder. Türk hukuk sistemindeki insan haklarıyla ilgili hükümler, anayasanın özel koruyucu şemsiyesi altında olduğundan, diğer anayasal ve yasal düzenlemeler karşısında hiyerarşik olarak üstün bir konumda supranorm bulunurlar. TBMM' de kabul edilen Anayasa değişiklikleri türlü eksiklik ve yetersizliklerine karşın, esasında özgürlükçü bir temel hak ve hürriyetler rejimi oluşturma açısından atılan önemli bir adım olmuştur

The notion of "human rights" refers to the compilation of all the rights of an individual that he/she possess for just being a human since his/her birth, and that can not be intervened by either government or other individuals. In Turkish legal system, the norms concerning human rights, which are under the special protection of the constitution, are hierarchically superior to the other constitutional and legal regulations. Despite having some deficiencies and incompetencies, recent amendments in the Constitution by TGNA, actually is an important step taken towards developing a liberal system of fundamental rights and freedoms
