Cumhurbaşkanlığı sistemi ve merkez-yerel yönetim ilişkisi üzerine genel bir değerlendirme

Abstract

Yerel yönetimler, demokrasinin tabandan tavana doğru yayılmasını sağlayan, halka en yakın birim olmaları dolayısıyla halkın denetimini etkin kılan demokrasi okullarıdır. Hesapverebilirliği güçlendiren söz konusu birimler, bulundukları ülkelerin tarihi tecrübeleri, sosyo-ekonomik koşulları ve hükümet sistemleri gibi faktörlerin etkisi altında şekillenmektedir. Nitekim Türkiye’de yürütülen yeni anayasa çalışmaları ve Cumhurbaşkanlığı sistemine geçiş yönündeki tartışmalar yerel yönetimlerin durumunu ele almayı gerekli kılmaktadır. Genel anlamda yasama, yargı ve yürütme ilişkilerinin anayasal olarak tasarlanması olarak ifade edilen hükümet sistemi, bir ülkenin demokrasi ve özgürlük değerlerini doğrudan belirlemektedir. Buna bağlı olarak Cumhurbaşkanlığı sistemine geçiş tartışmalarının merkezinde yer alan konulardan biri yerel yönetimlerin siyasal ve yönetsel sistem içerisindeki biçimlenişidir. Çalışmanın amacı, sistemin bir parçası olarak yerel yönetimlerin söz konusu sistemde nasıl konumlandırılacağını, dönüşen sistem ile birlikte merkez-yerel ilişkilerinin mevcut mekanizmalar yoluyla sürdürülebilirliğini çeşitli ülke örnekleriyle değerlendirmektir. Bu kapsamda çalışmada sistemin karşılaştığı eleştirilere genel olarak değinilerek, özellikle yerel yönetimler temelinde gündeme getirilen federalizm ve bağımsızlık düşüncelerinin kaçınılmaz sonu yansıtmadığı savunulmaktadır. Bu amaçlar doğrultusunda yöntem olarak, literatür taraması ile çalışmanın temelini oluşturan kavramlar açıklanmış, konu üzerine yazılmış basılı eserlerden, basın taraması esnasında ulaşılan gazete arşivlerinden, yasal 369 düzenlemelerden yararlanılarak metin analizi yöntemi kullanılmıştır.

Local governments are the schools of democracy, that provide the spread of democracy and which activates the control of the people due to the closest units to the people. The units that strengthen accountability are shaped by factors such as the historical experience of their countries, socio-economic conditions and government systems. Thus, the debate on new constitution and the transition to a presidential system in Turkey is necessitates handle of the situation of local governments. In general terms, the governmental system, which is expressed as a constitutional design of legislative, judicial and executive relations, directly determines the values of democracy and freedom. Therefore, one of the issues at the center of the discussions on the transition to the presidency system is the formation of local governments in the political and administrative system. The aim of the study is evaluate how local governments are positioned in the system, as part of the system. It is also to evaluate the sustainability of central-local relations through existing mechanisms with examples from various countries. In this context, it is argued that the federalism and independence ideas discussed on the basis of local governments do not reflect the inevitable consequence. As a method for these purposes, the concepts underlying of study with literature search were explained and text analysis methods were used by using from the printed works written on the subject, from the newspaper archives reached during the press screening, from legal regulations
